The following general terms and conditions apply to offers, orders and contracts.

1. Prohibition of passing on

All information including the property records of the company Graf Immobilien GmbH are exclusively intended for the customer. The customer is prohibited from passing on the property records and property information to third parties without the prior written consent of Graf Immobilien GmbH.

If the customer violates this obligation and if a third party or other persons to whom the third party in turn has passed on the information conclude the main contract, the customer is obliged to pay the commission agreed upon with the company Graf Immobilien GmbH plus the respectively applicable value added tax.

2. Double activity

Graf Immobilien GmbH may act on behalf of both the seller/lessor and the buyer/tenant subject to commission.

3. Property details

The company Graf Immobilien GmbH expressly points out that the property information passed on by it comes mainly from the seller/landlord, from a third party or from the minutes in files of the building authority or land registry and that it, the estate agent, has neither checked for correctness nor for completeness.

4. Data protection

All personal and property-related data are used exclusively for the processing of the order by Graf Immobilien GmbH. The client consents to the transfer of data to third parties if this is necessary for the fulfilment of the order. The data will not be passed on in any other way. In accordance with the German Civil Code (BGB), we are obliged to grant you the right of access to your contact data stored by us and to have this data corrected if necessary or deleted on request.

5. Commission claim

With the conclusion of a main contract that has come about through our proof or our mediation, the customary local commission in the amount of 3.48 % including the statutory value added tax is due in accordance with §652 BGB, unless otherwise agreed.

6. Limitation of liability

In the case of slightly negligent breaches of duty, liability and that of our vicarious agents shall be limited to foreseeable damage typical of the contract. Neither we nor our vicarious agents shall be liable for slightly negligent breaches of non-substantial contractual obligations, the breach of which does not endanger the performance of the contract. Essential to the contract is an obligation, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the buyer may regularly rely. Our liability under the Product Liability Act or under guarantee remains unaffected by this. Furthermore, the limitations of liability do not apply in the case of bodily injury and damage to health attributable to us or in the case of loss of life of the customer. Graf Immobilien GmbH does not provide tax advice.

7. Insurance

There is insurance protection through a financial loss & business liability insurance.

8. Place of jurisdiction

If the customer is a merchant, legal entity under public law or special fund under public law, the place of performance for all obligations and claims arising from the contractual relationship shall be the registered office of Graf Immobilien GmbH

9. Severability clause

In the event that one or more provisions of these terms and conditions should be invalid or unenforceable, or become invalid or unenforceable retroactively, the remaining provisions shall remain unaffected, unless the omission of individual clauses would put one party to the contract at such unreasonable disadvantage that it can no longer be reasonably expected to adhere to the contract. Insofar as the provisions have not become part of the contract or are invalid, the content of the contract shall be governed by the statutory provisions.
